GENERAL TERMS AND CONDITIONS OF SALE SITE AT4.COM
This website (hereinafter the “ website ") is published by the company AT4 France, simplified joint stock company with capital of €600000, whose head office is located at 80 route de Binans – 39570 Publy, registered in the Lons-Le-Saunier Trade and Companies Register under number 839 694 692 (hereinafter “ AT4 France »).
AT4 France is registered in the National Register of Furniture Manufacturers under number FR025963_10VEEH and Toys under number FR025963_12RPNU. These numbers guarantee that AT4 France, by joining Eco-mobilier, is complying with the regulatory obligations incumbent upon it under article L 541-10-1 10° of the Environmental Code.
AT4 France is registered in the National Register of Packaging and Graphite Paper Producers under numbers FR025963_01OUOT and FR025963_03TNQZ. These numbers guarantee that AT4 By joining CITEO, France complies with the regulatory obligations incumbent upon it under Articles L.541-10 and R.543-53 to R.543-65 of the Environmental Code.
Article 1 – Scope of application of the General Conditions of Sale
These general terms and conditions of sale apply to all orders for Products offered for sale by AT4 France past on the website www.at4.com (hereinafter "The Site") by a Client of legal age, a consumer within the meaning of French law and jurisprudence, hereinafter referred to as "The Client".
The Customer declares to have full legal capacity allowing him to commit under these general conditions of sale.

Any document other than these general conditions of sale and in particular catalogs, prospectuses, advertisements, notices, has only an informative and indicative value, not contractual.
The fact for AT4 France's failure to invoke any of the clauses of these general terms and conditions at any given time shall not constitute a waiver of the right to invoke them subsequently.
AT4 France reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in effect on the date of the order will apply to each order.
In the event that one of the provisions of these conditions is considered void for any reason whatsoever, all the other provisions of these conditions will remain binding between the Parties.
Article 2 - Order
2.1 Products
Any merchandise referenced on the Site can be immediately ordered subject to availability. The availability of a Product is indicated directly on its description sheet.
Product and price offers are valid as long as they are visible on the Site, and under the availability conditions provided at the time of placing the order.
If, despite all the precautions taken by AT4 France, in order to indicate the real-time availability of its Products on its Website, should a Product become unavailable after an Order has been placed, the Customer will be informed as soon as possible by email of the timeframe within which the Product will become available. Customers who do not wish to wait for the Product to become available, or in the event of the Product's permanent unavailability, will be refunded the price of the Product if their bank account has been debited, within thirty days of the actual payment date; the remainder of the order will remain firm and final.
Any order constitutes acceptance of the prices and description of the Products available for sale.
The visual presentations (images, photos, drawings, etc.) which appear on the Site are provided for illustrative purposes. For technical reasons (photographic and IT), the actual rendering of the Products may differ from that of the photographs presented on the Site.
The Customer must refer to the descriptions of each Product in order to know its precise characteristics.
2.2 Placing the order
Orders are placed exclusively through the Site; orders made by mail or telephone will not be taken into account.
The Customer places his order on the Site, from the online catalog and using the form therein.
The Customer must follow the different ordering steps on the Site, selecting the desired Products. He then validates his choice by clicking on the “Order” icon.
All Products ordered are the subject of a summary so that the Customer can check the details of his order and its total price, and correct any errors, before confirming this to express his acceptance.

2.3 Customer Account
Placing an order on the Site is subject to the prior and free creation of a Customer Account on the Site.
When creating their Customer Account, the Customer agrees to provide accurate and truthful information about their situation. This includes providing their surname, first name, postal address, telephone number, and email address, and choosing login credentials (a username and password). The uniqueness of the username will then be verified by the computer system implemented by AT4 France. These strictly confidential identifiers will be requested from the Client for each transaction.
The password can be changed online from your Customer Account. This password is personal, confidential and non-transferable, and the Customer therefore undertakes not to communicate it to third parties.
Any access to the Customer's Account, using their password, is deemed to have been made by the Customer. AT4 France cannot, under any circumstances, be held responsible for fraudulent or abnormal use of the password and/or the Customer Account.
AT4 France also reserves the right to use the Client's password exclusively for the technical maintenance of the Site. AT4 France guarantees under these conditions the permanent maintenance of the confidentiality of the Client's password.
The Customer agrees to take care of these identifiers and must immediately report any loss in writing in order to relieve liability.
If the password is lost or forgotten, the Customer can click on a “forgotten password” link and enter their email address. He will receive by email a link for creating a new password.
The customer agrees to regularly check their personal data before each new order, and to make any necessary changes online in their Customer Account. AT4 France draws the Client's attention in particular to the need for the latter to provide a valid email address and telephone number.
2.4 Payment
The Customer's order is payable in cash on the day of the order. Payment is made by bank card (Carte Bleue, Visa, Eurocard/Mastercard).
The Client guarantees to AT4 France that he has the necessary authorizations to use the payment method he will have chosen for his order, when registering his order form and that he has sufficient funds to cover all costs resulting from this order.
AT4 France reserves the right to request a photocopy of the Client's identity card and/or, where applicable, bank card (front only) for any payment by bank card.
As part of the fight against online fraud, information relating to the Customer's order may be transmitted to any third party authorized by law or designated by AT4 France solely for the purpose of verifying the Customer's identity, the validity of the order, the payment method used, and the intended delivery. When a payment method is issued by a banking institution, only those methods are accepted by AT4 France means the funds issued by a banking or financial institution authorized to operate in France.

In accordance with Article L. 121-11 of the Consumer Code, AT4 France reserves the right to refuse an order for legitimate reasons, which it will inform the Customer of by email; such reasons will include, in particular, the lack of all or part of the information necessary for the processing and delivery of the Products ordered, the permanent unavailability of the Products ordered, the refusal of authorization of payment by bank card by officially accredited organizations, non-payment, an abnormal order or one placed in bad faith.
Article 3 - Price
The prices of the Products offered on the Site are invoiced in euros, all taxes included (VAT applicable on the day of the order) excluding participation in processing and shipping costs (port, packaging, preparation of the package), determined according to the weight, of the volume and nature of the Products and their place of delivery, indicated before final validation of the order. ARTICLE 4 – DELIVERY
4.1 Place of Delivery
The products are delivered to mainland France and certain European countries. The destination must be entered in the basket when ordering. Shipping costs update automatically.

4.2 Shipping methods
The Products ordered will be delivered:
– either at the Customer’s home;
– or to another address of your choice and mentioned when ordering.
Delivery is made at the foot of the building (not on the floors) and sometimes on a pallet (depending on the order).
Packages can be heavy and bulky, the customer must ensure that they are helped to receive the goods.

Never, AT4 France cannot be held responsible for any deterioration of the Products in the event of late collection of said Products from the carrier, or failure to collect the Products by the Customer. A delivery delay, or non-delivery due to inaccuracies or errors in the information provided by the Customer, will not give rise to any refund. Any package returned to the seller due to an incorrect or incomplete delivery address will be reshipped. at the Customer's expense.
4.3 Deadlines
For items listed as "available" on the website www.at4. Com AT4 France is committed to preparing orders within a maximum of 2 working days.
The delivery time by the transport company varies depending on the items, their volume, their number and their weight.

Article 5 – Transfer of ownership / Transfer of risk
By way of derogation from Article 1196, paragraph 1 of the Civil Code, AT4 France expressly retains ownership of the delivered Products until full payment of their price. In the event of default by the Customer, AT4 France reserves the right to repossess the Products.
The transfer of risks, including loss, destruction, damage or theft of the Products, to the Customer will take place upon confirmation of the order by AT4 France, embodying the agreement of the Parties on the object and on the price.
Shipping and transport are therefore at the Customer's own risk.
Article 6 – Right of withdrawal and cancellation
In accordance with the provisions of article L.121-21 of the Consumer Code, the Customer, consumer, has a withdrawal period of 14 days from receipt of the Product by the Customer or a third party, other than the carrier, designated by him, allowing him to cancel all or part of his order and return the Product at his expense.

The products must be returned by the Customer within a maximum period of 14 days following communication of their decision to withdraw.
The Products must be returned in their original packaging, properly protected. Any damage suffered by the product may entitle us to only partially reimburse the customer.

Information concerning the exercise of the right of withdrawal

Effects of withdrawal:

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you expressly agree to a different means; in any case, this reimbursement will not incur any costs for you.
The costs of reshipping the returned product remain the responsibility of the customer who withdraws from his order.
Order cancellation information
Possibility of cancellation:
Cancellation of the order is possible, free of charge, as long as the order has not been shipped. In this case, the order is canceled and refunded in full by our services.
If the cancellation request occurs while the item is already in transit or delivered, it will then be a withdrawal and the return costs will be the responsibility of the customer.
Article 7 – Product Conformity
The Customer must check the conformity of the goods delivered or collected before signing any delivery document. The Customer must indicate on the delivery note and in the form of handwritten reservations accompanied by his signature any apparent defect concerning the delivery.
These reservations must be confirmed by registered letter to the head office of AT4 France within 4 days of delivery.
If no reservation is confirmed within this period, no claim for apparent defects will be accepted by AT4 France and the delivered product will be deemed compliant.
If the delivery does not correspond quantitatively to the order, AT4 France will only reimburse the price difference between the Products ordered and those delivered.
In the case of a damaged Product or one that does not correspond to the Customer's order, AT4 France undertakes to proceed with an exchange or a refund, excluding any other compensation and interest.
AT4 France will send a letter confirming its acceptance of the return of the Product(s), and where applicable, a return number which must be included on the package when returning the non-compliant or defective Product.
In case of non-conformity, any returns should be sent to the following address: AT4 France, in their original condition and complete and within 8 (eight) calendar days from receipt of the order.
Products returned incomplete, damaged, soiled, removed from their packaging by the Customer, or not subject to express reservations upon delivery under the conditions of this article, are not taken back.
In the event of proven and validated non-compliance by AT4 France, the return shipping costs will be borne by AT4 France will organize the collection of the package(s).

Article 8 - Legal guarantees

Article 9 – Contractual guarantee
AT4 France guarantees its products against any defect in material or workmanship for a period of two years from the date of delivery.
Under this guarantee, any supply of non-compliant goods will only involve reimbursement or replacement of defective parts or materials to the exclusion of any other compensation. Any shipping costs will remain the responsibility of the Customer.
The warranty does not cover apparent defects as defined in Article 7 herein. Also excluded are any defects or damage caused by normal wear and tear, misuse of the product by the Customer, or any modification to the product not authorized or specified by the Customer. AT4 France.
Any replacement during the warranty period cannot have the effect of extending the warranty period of the products.
Article 10 - Liability

AT4 France shall in no event be held liable, either to the Client or to third parties, for any indirect damage.
The products offered comply with current French and European legislation. The Customer is responsible for checking with local authorities regarding the import or use of the Products or services they intend to order.
The Customer is deemed to have perfect knowledge of the Products he is purchasing and recognizes by placing an order for a Product that he has been able to obtain the information relating to the one ordered, in particular by the sole description and information appearing on the Site.
AT4 France may always prevent a liability claim by bringing the product into compliance or by replacing a defective or non-compliant product, it being understood that AT4 France does not accept any returns of Products without prior authorization.

For all stages of accessing the site, browsing, filling out forms, and placing orders, AT4 France only has an obligation of means.

Article 11 – Force majeure exemption clause
In the event of non-performance of obligations provided for in these general conditions resulting from a case of force majeure or a fortuitous event, the parties incur no liability. Article 12 – Suspension – Termination
The Customer may cancel their registration on the Website and close their account at any time. To do so, the Customer should send their cancellation request to AT4 France.
In the event of a breach by the Client of any of its contractual obligations, particularly in the event of a payment incident, AT4 France reserves the right to suspend the Client's access to the Site, or even terminate their account depending on the severity of the breaches. Article 13 – Applicable law and dispute resolution
The language of this contract is French. This agreement is governed by French law.

Article 14 – Intellectual Property
All elements published on the Website, such as sounds, images, photographs, videos, texts, animations, programs, graphic design, database utilities, software, and other underlying technology, are protected by the provisions of the Intellectual Property Code and belong to AT4 France.
Brands AT4, JURABABY, WEBABY as well as all illustrations and images appearing on the articles, their accessories or their packaging, whether registered or not, are and will remain the exclusive property of AT4 France.

Article 15 – Personal information
In accordance with the provisions of Law No. 78-17 of 6 January 1978 relating to information technology, files and freedoms, and the decision of the CNIL (National Commission for Information Technology and Freedoms) of 10 July 2006, AT4 France has declared its customer/prospect file to the CNIL.
The Client is informed that data concerning him/her may be included in personal data files, to be used by AT4 France in compliance with the legal provisions in force in the context of the implementation of services offered to Clients on the Site, for the establishment of statistics for internal use as well as to strengthen and personalize communication with the latter.
The Customer has been clearly informed that they have the right to object, for legitimate reasons, to the processing of their personal data and that they may, at any time, request access to or rectification of any information concerning them held in the files by logging into their Customer Account, or by sending a letter or email to AT4 France.
